Court Watch - Title VI Cases. Robinson v. Kansas -- F.3d -- , 295 F.3d 1183. (10th Cir. July 9, 2002). Court held that state governor and education officials had no eleventh amendment immunity from suit for action under Section 504 and Title VI. The court also held that the disparate impact regulations under Title VI could by enforced through Section 1983 for prospective injunctive relief, and that Alexander v. Sandoval did not hold otherwise. Supreme Court denies state’s petition for writ of certiorari in Kansas v. Robinson, 123 S. Ct. 2574 (2003).
